Terms and Conditions of Use - Iberbrain App

These Terms and Conditions of Use should be read together with the Privacy Policy and the Safe Use Declaration of the Iberbrain App. In the event of any inconsistency relating to the processing of personal data, the Privacy Policy shall prevail.

These Terms and Conditions govern access to and use of the Iberbrain App. By creating an account and using the application, the user confirms that they have read, understood and accepted these Terms and Conditions. If the user does not agree with any provision of these Terms and Conditions, they must not use the application.


1. PURPOSE OF THE APPLICATION

Iberbrain is a cognitive training and mental stimulation application that integrates its own exercises, programmes and methodologies, incorporating elements of the Ronnie Gardiner Method® (RGM), alongside other cognitive training methodologies and approaches.

The application is intended for personal, educational, institutional, professional and non-clinical therapeutic use. It is not a medical device and does not replace healthcare services provided by qualified healthcare professionals. Iberbrain is a support tool for cognitive training and does not replace medical, psychological or clinical assessment, diagnosis or treatment. No specific cognitive, physical or functional outcomes are guaranteed.


2. USER LICENSE

By using the application, the user is granted a personal, limited, non-exclusive, non-transferable and revocable licence. This licence is granted solely for the use of the application as provided for in these Terms and Conditions. No intellectual property rights are transferred to the user.


3. REGISTRATION AND ACCESS

Access to the application requires the creation of a user account linked to a valid email address. Authentication is securely performed via single-use Magic Links sent to the registered email address.

The user is responsible for maintaining the confidentiality and security of access to their email account, as it constitutes the sole authentication method for the application. The user agrees to provide accurate, complete and up-to-date information.

Use by Minors

The application is intended for users who have reached the minimum age required under the applicable legislation to validly consent to the use of information society services. Where required by applicable law, use of the application by minors is subject to the consent or authorisation of their parent or legal guardian.


4. ACCEPTABLE USE

The user agrees to use the application lawfully and responsibly. The following are strictly prohibited:

  • illegal or abusive use of the application;
  • unauthorised access attempts;
  • interference with system operation;
  • reverse engineering, decompilation, or code extraction attempts;
  • use of automated systems for data extraction;
  • account sharing or transfer;
  • violation of intellectual property rights.

5. INSTITUTIONAL USE

The application may be used by institutions, including schools, care homes, clinics, associations, companies, and other organisations. Where applicable, specific licenses shall prevail over these Terms.


6. INTELLECTUAL PROPERTY

All intellectual property rights relating to the Iberbrain application belong to its creator, Susana Coutinho, unless otherwise stated. Protected elements include, but are not limited to: software and source code; system architecture; user interface and design; brand identity and logos; databases; documentation; educational content; exercises and training sequences; programmes and methodologies; multimedia content; pedagogical adaptations; digital learning materials.

Use of the application does not confer upon the user any ownership or intellectual property rights over the application or its contents. Any unauthorised reproduction, distribution, modification, reverse engineering, or commercial exploitation is strictly prohibited.


7. RONNIE GARDINER METHOD® (RGM) & THIRD-PARTY INTELLECTUAL PROPERTY

The Iberbrain application includes its own programmes, exercises and activities incorporating elements of the Ronnie Gardiner Method® (RGM), together with other cognitive training methodologies and approaches. The Ronnie Gardiner Method® is a methodology created by Ronnie Gardiner and is protected by intellectual property rights.

The creator of the Iberbrain application, Susana Coutinho, has completed the three official certification levels of the Ronnie Gardiner Method®, qualifying her for professional practice of the methodology, including the design and delivery of sessions and the development of exercises within the RGM framework.

Iberbrain is an independent technological development that incorporates original content, programmes, exercises, pedagogical adaptations, and digital resources created by its author, while respecting the intellectual property rights associated with the Ronnie Gardiner Method®. Unless expressly stated otherwise, Iberbrain is not an official Ronnie Gardiner Method® application and does not imply any affiliation, partnership, representation, or endorsement by Ronnie Gardiner or the entities responsible for the certification or governance of the method.


8. THIRD-PARTY CONTENT

The application may include third-party content such as music, audio, images, icons, and other digital resources. Where applicable, such content is used under open licenses, including Creative Commons, or other legally authorized licenses.

Attribution information is displayed within the application, including: author; title; source; license type; link or reference to the license. Such content remains the property of its respective rights holders. Users may not copy, extract, redistribute or reuse third-party content outside the application unless expressly permitted by the applicable licence.


9. SERVICE AVAILABILITY

The application aims to provide continuous availability. However, temporary interruptions may occur due to: maintenance; updates; technical improvements; security reasons; external factors beyond reasonable control. Continuous, uninterrupted availability is not guaranteed.


10. LIMITATION OF LIABILITY

Iberbrain seeks to provide a secure, reliable application that is suitable for the purposes described in these Terms and Conditions. The application is a cognitive training tool and does not replace professional medical, psychological or other healthcare advice, assessment, diagnosis, treatment or follow-up. The user acknowledges that performing the exercises requires active participation and agrees to follow the safety instructions provided by the application, while respecting their own physical and cognitive limits.

Without prejudice to any liability that cannot legally be excluded, Iberbrain shall not be liable, in particular, for any direct or indirect loss or damage resulting from:

  • use of the application contrary to the instructions provided;
  • use of the application by persons who are not in an appropriate physical or medical condition to perform the exercises;
  • failure to seek medical advice where such advice would be appropriate;
  • continued use of the application after experiencing pain, dizziness, discomfort or any other symptoms requiring the activity to be stopped;
  • interruptions or unavailability of the service;
  • internet connection failures;
  • technical problems affecting the user's device;
  • force majeure events or other circumstances beyond Iberbrain's reasonable control.

Before commencing the exercises, the user must accept the Iberbrain App Safe Use Declaration, which forms an integral part of the safety recommendations applicable to the use of the application. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

The user also acknowledges that use of the application is at their own risk, without prejudice to any rights granted under mandatory applicable law.


11. DATA PROTECTION

Personal data processing is governed by the Iberbrain Privacy Policy, which forms an integral part of these Terms.


12. ACCOUNT SUSPENSION OR TERMINATION

Accounts may be suspended or terminated in cases of: misuse of the application; violation of these Terms; unauthorised access attempts; breach of intellectual property rights; unlawful use of the service. Where possible, users will be notified in advance.


13. CHANGES TO THE SERVICE

Iberbrain may modify, update, suspend or discontinue the application, in whole or in part, at any time for technical, operational, legal or security reasons. Where such changes materially affect access to, or the normal functionality of, the application, users will be informed within a reasonable period in advance, except where immediate action is required due to technical emergencies, cybersecurity reasons or legal obligations.


14. CHANGES TO TERMS

These Terms and Conditions may be updated from time to time to reflect changes in the law or improvements to the application. Registered users will be informed of any changes through the application or by email within a reasonable period before the changes take effect. If the user does not agree with the updated Terms, they may terminate their account without penalty. Continued use of the application after the notice period has expired constitutes acceptance of the updated Terms.


15. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.


16. GOVERNING LAW

These Terms are governed by the laws of the Netherlands. Without prejudice to this choice of law, consumers shall continue to benefit from any mandatory protections afforded by the laws of their country of habitual residence. Any dispute arising from the use of the application shall be subject to the jurisdiction of the competent courts of the user's country of residence where required by applicable consumer protection law.


17. ENTIRE AGREEMENT

These Terms and Conditions, together with the Privacy Policy and the Safe Use Declaration, constitute the entire agreement between Iberbrain and the user regarding the use of the application and supersede all prior or contemporaneous communications, proposals, negotiations, understandings or agreements, whether oral, written or electronic, relating to the same subject matter.
